What are Probation Violations?
Probation Violations occur if you get in legal trouble, fail a drug test, fail to show up for a drug test or drug treatment, fail to check in with your probation officer, fail to complete your community service, or fail to pay your fines or court costs. If any of these things happen, your probation officer will usually file documents with the court ordering you to appear in front of the judge that sentenced you to probation for a “violation of probation” hearing. There is no hard and fast rule for what type of violation will result in a probation violation. At the hearing, if the prosecutor is able to prove by a “preponderance of the evidence” standard that it is more likely than not that the person on probation violated the terms of his probation, the court may find the person guilty of probation violation.
