What are Drug Crimes?

Illinois Drug Laws classify the possession and delivery of various drugs by weight and amount. The Chicago Drug Crimes lawyers at The Legal Defenders are trained to understand and know the details of the Illinois Drug Laws. Under Illinois Drug Laws, the possession of a less than 2.5 grams of marijuana is a Class C misdemeanor. The possession of more than 2.5 grams but less than 10 grams of marijuana is a Class B misdemeanor. The possession of more than 10 grams but less than 30 grams of marijuana is a Class A misdemeanor. The possession of more than 30 grams but less than 500 grams of marijuana is a Class 4 felony. The possession of more than 500 grams but less than 2000 grams of marijuana is a Class 3 felony. The possession of more than 2000 grams but less than 5000 grams of marijuana is a Class 2 felony. The possession of more than 5000 grams is a Class 1 felony. If an individual has been convicted of a similar offense in the past, they may be facing more serious charges and penalties. Illinois Drug laws impose harsh penalties for the Manufacture or delivery of marijuana. The manufacture or delivery of as little as 10 grams of marijuana is a Class 4 felony under Illinois Drug laws. The Possession and the Manufacture or Delivery of controlled substances such as cocaine, heroin, morphine, methamphetamine (meth), amphetamine, or any other illegal drug is also classified according to weight and unit of measurement. Sentences and guidelines are set out in the Illinois Drug Laws according to the amount seized and weighed. Most of those drug charges are felonies which may result in substantial jail time and fines. The Chicago Drug Crimes lawyers at The Legal Defenders understand that Illinois Drug Laws also impose greater sentences if certain other factors are involved. For instance, if you are charged with possession of a drug within 1,000 feet of a school, church, public park, or a movie theater, the court may double the fine and the sentence. You can even be charged with possession or sale of a look-alike substance (fake drug) if the substance is packed in a manner to resemble a real drug. Illinois has adopted a strict sentencing guideline structure which mandates mandatory jail time for some drug offenses. These strict sentencing guidelines have accounted for a significant increase in the number of people incarcerated in the Illinois Department of Corrections (IDOC) in recent years. The consequences of violating Illinois drug laws continue to get worse with increasingly severe penalties if convicted of possession, trafficking, sale, delivery, distribution, or manufacture of controlled substances or marijuana.

If you are charged with violating the Illinois drug laws, make sure you hire an attorney that understands the details of the Illinois drug laws. The Chicago drug crimes lawyers at The Legal Defenders monitor the constant changes to the Illinois drug laws to make sure they are up to date on any changes that could impact their clients.

Consequences of a Drug Conviction?

The Chicago drug crimes lawyers at The Legal Defenders have been trained to understand the impact that a conviction for the violation of Illinois Drug Laws can have on an individual. In addition to the possibility of a long jail sentence, any felony conviction will make it difficult to get a job. Even a conviction for a minor marijuana charge will remain on your criminal record and will be viewed by prospective employers who may be unwilling to hire someone with a drug conviction on their record. If your child is convicted of a drug charge, their ability to obtain government student aid or college loans may be affected for a period of time after they are convicted. In addition, if you are not a citizen of the United States, a conviction for a drug offense may cause you to be deported and will never be allowed to return to the United States.

Because the impact of a conviction for a drug offense can have life-long and life-changing impacts on a client’s life, the Chicago drug crimes lawyers at The Legal Defenders take each case seriously and work within the system to obtain the best possible result for each client.
