WHAT IS VEHICLULAR HIJACKING OR CARJACKING?

Under Illinois Law (720 ILCS 5/18-3), a person commits the felony crime of Vehicular Hijacking, Carjacking, when:

(a) A person commits vehicular hijacking, or carjacking, when he or she takes a motor vehicle from the person or the immediate presence of another by the use of force or by threatening the imminent use of force.

(b) For the purposes of this Article, the term "motor vehicle" shall have the meaning ascribed to it in the Illinois Vehicle Code.

(c) Sentence. Vehicular hijacking, or carjacking, is a Class 1 felony and probation is not available pursuant to 730 ILCS 5/5-5-3(c)2.

Under Illinois Law, the sentence for Vehicular Hijacking, or carjacking, is a Class 1 felony. A Class 1 felony Vehicular Hijacking, or carjacking, is punishable by 4 to 15 years in prison. Under certain circumstances, the sentence for a Class 1 Vehicular Hijacking, or carjacking, can be extended to 15 to 30 years in prison. Probation for Vehicular Hijacking, or carjacking, is not available as a sentencing option according to 730 ILCS 5/5-5-3(c)2.

WHAT IS AGGRAVATED VEHICLULAR HIJACKING OR CARJACKING?

Under Illinois Law, (720 ILCS 5/18 4), a person commits the felony crime of Aggravated Vehicular Hijacking, or Aggravated Carjacking, when they commit a Vehicular Hijacking/Carjacking (see above): and

(1) the person from whose immediate presence the motor vehicle is taken is a physically handicapped person or a person 60 years of age or over; or

(2) a person under 16 years of age is a passenger in the motor vehicle at the time of the offense; or

(3) he or she carries on or about his or her person, or is otherwise armed with a dangerous weapon, other than a firearm; or

(4) he or she carries on or about his or her person or is otherwise armed with a firearm; or

(5) he or she, during the commission of the offense, personally discharges a firearm; or

(6) he or she, during the commission of the offense, personally discharges a firearm that proximately causes great bodily harm, permanent disability, permanent disfigurement, or death to another person.

Under Illinois Law, the sentence for Aggravated Vehicular Hijacking, or Aggravated Carjacking, is a Class X felony. A Class X felony Aggravated Vehicular Hijacking, or Aggravated Carjacking, is punishable by 6 to 30 years in prison. Under certain circumstances, the sentence for a Class X felony Aggravated Vehicular Hijacking, or Aggravated Carjacking, can be extended to 30 to 60 years in prison. Probation is not available for a conviction for a Class X felony Aggravated Vehicular Hijacking, or Aggravated Carjacking, pursuant to 730 ILCS 5/5-5-3(c)2.
